Important information before you read these terms
Homesure provides home repair, maintenance and emergency-assistance services under a service agreement. This Plan is not an insurance policy. The exact services included are shown in your Plan Summary and are subject to these Terms and Conditions.
For eligible home emergencies, our emergency assistance line is available 24 hours a day. Engineer attendance is subject to availability and the Contractor's working arrangements. Appliance breakdowns are not treated as home emergencies and are handled through our customer service team during its published opening hours.
To request assistance, call 0800 068 3534. If you smell gas or suspect a gas or carbon-monoxide emergency, call the National Gas Emergency Service on 0800 111 999.

3. ABOUT US
3.1. We are Homesure Warranties Ltd, a company registered in England and Wales. Our company registration number is 11015889. Our registered office is Alum House, 5 Alum Chine Road, Westbourne, Bournemouth, Dorset, England, BH4 8DT.
3.2. You can contact us by telephoning 0800 068 3534 or emailing customerservice@homesurewarranties.co.uk. Postal correspondence may be sent to our registered office unless we provide a different correspondence address on our website or in your Plan documentation. Calls may be recorded and monitored for quality, training and dispute-resolution purposes; see our Privacy Policy for more information.
3.3. Our ordinary customer service opening hours are shown on our website. Eligible home-emergency assistance may be available outside those hours as stated in your Plan Summary, but this does not guarantee 24-hour engineer attendance.
3.4. If we have to contact you, we may do so by telephone, email or post using the details you have provided.
3.5. When we use the words "writing" or "written" in these terms, this includes email.
4. OUR CONTRACT WITH YOU AND ELIGIBILITY
4.1. The Plan comes into existence when we confirm acceptance of your order by email or another durable method. The Plan starts on the start date shown in your Plan Summary. Unless your Plan Summary expressly says otherwise, you cannot make a repair request during the first 30 days from the start date.
4.2. You must be at least 18 years old and resident in the United Kingdom. Each Product must be in good working order when the Plan starts (or when it is added to the Plan). You must be the owner occupier or a private tenant of the Home to which the Plan relates. Private tenants must have any permission reasonably required from their landlord before we can provide services.
4.3. Each Product must be outside any applicable manufacturer parts-and-labour guarantee when you take out the Plan or add the Product, unless we agree otherwise in writing.
4.4. If we cannot accept your request for a Plan, we will tell you and will not charge you for services we have not agreed to provide.
4.5. We will assess repair and replacement requests in accordance with these Terms and Conditions, your Plan Summary and the applicable service limits. We may refuse a request that falls outside the scope of the Plan or where an exclusion applies. This is a contract for services and is not a contract of insurance.
5. DURATION AND RENEWAL OF YOUR PLAN
5.1. The initial Plan Period begins on the start date in your Plan Summary and continues until the renewal date shown there, unless you or we end the Plan earlier in accordance with these terms.
5.2. Before the Plan Period ends, we will write to you about renewal. The renewal notice will show the new fee and any material changes. We will aim to send this notice at least 14 days before renewal.
5.3. Where your payment arrangement is set up to continue automatically, your Plan will renew for a further Plan Period unless you cancel in accordance with these terms before the renewal date. The renewal notice will explain the amount and payment frequency that will apply.
5.4. If your payment method does not renew automatically, you will need to make the required payment or set up a new payment arrangement for the Plan to continue.
5.5. We reserve the right not to renew or offer to renew a Plan, subject to applicable law and any notice requirements.
6. PLAN CRITERIA
6.1. You must provide information we reasonably request when you apply for the Plan and ensure that all information you provide is correct, complete and not misleading.
6.2. Each Product must have been installed, maintained, serviced and used in accordance with the manufacturer's instructions and any legal requirements.
6.3. Each Product must be owned by you and kept only for domestic use.
6.4. Each Product must be used in a private Home occupied by a single household at the address given to us.
6.5. Each Product must be reasonably accessible, meet relevant safety standards and be safe to work on.
6.6. You must take reasonable steps to limit damage once you become aware of a fault, damage or breakdown.
6.7. The Product and work requested must fall within the services stated in your Plan Summary and the Items Included section of these terms.
6.8. For an eligible Home Emergency, Emergency Costs will only be considered where your payments are up to date, the incident is reported to us as soon as reasonably possible and in any event within 48 hours of you becoming aware of it, and you use the Contractor selected or approved by us unless we agree otherwise under clause 9.
7. YOUR OBLIGATIONS
7.1. If work is required to make a Product safely accessible for repair, you are responsible for arranging that work before requesting repair or replacement services. If safe access is not provided, we may refuse or postpone the repair.
7.2. If you do not allow access at an agreed appointment without a good reason and, despite reasonable efforts, we cannot contact you or rearrange access, we may end the Plan in accordance with clause 18.
7.3. When requesting a repair, you must tell us about any special access or safety requirements. We may request relevant certification or evidence before undertaking work.
8. WHAT YOUR PLAN INCLUDES
8.1. FAULT OR BREAKDOWN: If a Product suffers a fault or mechanical or electrical breakdown after any applicable manufacturer parts-and-labour guarantee has ended, our customer service team may first try to resolve the problem remotely. Where the issue cannot be resolved remotely, we will assess whether the request falls within your Plan. Where approved, we may authorise a Contractor to repair the Product or, at our discretion and subject to these terms, replace or contribute towards replacement of the Product or relevant part.
8.2. SERVICE LIMITS: There is no stated limit to the number of repair requests you may make, but each individual repair or replacement request is subject to a maximum service limit of £500 and the total maximum service limit is £2,000 in any Plan Period. We will not be liable for repair and/or replacement costs above those limits unless your Plan Summary expressly states a different limit.
8.3. START OF SERVICES: Unless your Plan Summary expressly states otherwise, repair requests cannot be made during the first 30 days from the start date of the Plan.
8.4. BOILER SERVICING: Where your boiler is included in the Plan, you become entitled to one boiler service after the Plan has been in place for more than 12 months. Please contact us to arrange this. Boiler services are generally scheduled between March and September, subject to availability and operational requirements. If we attend to repair the boiler, we may complete service checks during the same visit where appropriate.
8.5. WHO WE USE: We may use independent Contractors to carry out repairs and services on our behalf.
9. IMPORTANT INFORMATION ABOUT REPAIRS
9.1. HOW TO REQUEST A REPAIR: Contact us as soon as possible using the telephone number shown on your Plan Summary or 0800 068 3534.
9.2. INFORMATION WE MAY REQUIRE: You must provide your Plan details and, for Appliances, we may ask for original proof of purchase or other evidence reasonably required to verify eligibility. Requested documents may be provided electronically or by another method we agree with you.
9.3. AUTHORISED REPAIRERS: Only Contractors approved by us may carry out repairs under your Plan unless we agree otherwise in advance. Repairs will normally be arranged during the Contractor's normal working hours on a date agreed with you. Emergency assistance-line availability does not guarantee immediate or out-of-hours attendance.
9.4. REQUIREMENTS: You should have your Plan documentation or Plan details available when the repairer attends.
9.5. ALTERNATIVE REPAIRERS: If we approve a repair but cannot provide an approved Contractor, we may permit you to use a repairer chosen by you. You must obtain our approval before instructing them. You may have to pay them directly and request reimbursement from us, subject to the service limits in clause 8.2 and receipt of a valid invoice.
10. REPLACEMENTS
10.1. If a repair is approved, we may decide to replace part or all of a Product with a new product of the same or similar model and technical specification, subject to the Plan limits and exclusions.
10.2. If we decide a Product needs replacement but cannot reasonably arrange it, we may provide vouchers or another agreed settlement method up to the applicable service limit.
10.3. Any voucher will be issued by a retailer chosen by us and will be subject to the voucher provider's validity period and terms. If a voucher is not reasonably available, we may provide a cash equivalent, subject to the Plan limits.
10.4. Responsibility for vouchers passes to you when they are delivered to the contact address or electronic contact method you have provided.
10.5. If a manufacturer replaces a Product or part under a manufacturer guarantee, the Plan may continue in relation to the replacement where it remains eligible and we are notified of the replacement.
10.6. If we replace a Product under the Plan, we may issue an updated Plan Summary showing the replacement Product.
10.7. We reserve the right to end the Plan following replacement of a Product by giving at least 28 days' notice. If we do so, we will refund any fees paid in advance for the remaining unexpired part of the Plan Period on a pro-rata basis, subject to any amount properly due to us.
11. PRODUCT DISPOSAL, DELIVERY, INSTALLATION AND OTHER COSTS
11.1. If a Product or part is removed from your Home for repair and is replaced by us, the original may become our property and we may dispose of it. Where the original remains at your Home, you are responsible for its disposal unless we agree otherwise.
11.2. Unless your Plan Summary states otherwise, you are responsible for installation of a replacement Appliance and associated costs. We are responsible for fitting parts as part of an approved Appliance repair where the fitting is included in the approved work.
12. WHAT HAPPENS IF WE DECIDE NOT TO REPAIR OR REPLACE?
12.1. If we decide not to approve a repair request which would otherwise fall within the scope of the Plan, we will explain our decision. Unless the refusal is because you have breached these terms or because an exclusion or service limit applies, we will refund fees paid by you for the current Plan Period and the Plan will end. We will confirm this in writing.
13. WHAT IS EXCLUDED FROM YOUR PLAN?
Unless specifically included in the Special Conditions of your Plan Summary, the following are excluded and we will not carry out or pay for repairs which involve or relate to:
13.1. Any damage, fault, breakdown or other issue arising before the applicable service start date.
13.2. Any matter existing at the start of the Plan which you knew, or reasonably should have known, could result in a repair request.

13.4. Any cost already covered by a manufacturer, supplier or repairer guarantee or warranty.
13.5. A manufacturer or supplier recall or replacement programme.
13.6. Work required solely to make a Product comply with legislation or to make it safely accessible.
13.7. For boiler-only Plans, anything outside the boiler itself and its control panel, including pipes leading to or from the boiler, flue, air units, radiators, immersion heaters and water tanks, unless the relevant item is expressly included in your Plan Summary. Boilers must also satisfy the boiler eligibility requirements below.
13.8. Failure to follow the manufacturer's instructions.
13.9. A problem with the external supply of electricity, gas, water, broadband or broadcast content.
13.10. Routine maintenance, cleaning, servicing and re-gassing, except where a specific service (such as an eligible boiler service) is expressly included.
13.11. Repairs carried out outside the United Kingdom unless we agree otherwise in writing.
13.12. Consequential or incidental loss arising from loss of use of a Product, except where liability cannot lawfully be excluded.
13.13. Damage to other property or possessions unless caused by our negligence or breach of contract.
13.14. Cosmetic damage such as paintwork damage, dents or scratches which does not prevent normal operation.
13.15. Theft, attempted theft, neglect, deliberate damage or damage caused by animals, plants or trees.
13.16. Damage caused by events such as earthquake, flood, lightning, fire, wind, extreme weather, corrosion, chemical exposure, explosion, terrorism, war, civil disturbance or similar external events, except where liability cannot lawfully be excluded.
13.17. Any Appliance or item not registered under your Plan or not shown in your Plan Summary.
13.18. A call-out where you are not present or we cannot reasonably access the Product at the agreed time.
13.19. Subsidence, landslip or heave.
13.20. Loss or damage caused by faulty workmanship or DIY that does not comply with recognised industry standards.
13.21. Trace-and-access, redecoration or making-good costs, or permanent remedial works to the fabric of the Home, except where expressly included in your Plan Summary or where liability cannot lawfully be excluded.
13.22. Garages, outbuildings, cess pits, fuel tanks or septic tanks unless expressly included.
13.23. Nuclear, radioactive, war or terrorism-related losses of the type described in the previous solicitor-drafted terms, except where exclusion is prohibited by law.
13.24. A design fault making the Product inadequate or unfit for use, unauthorised repairs or maintenance, or failure to maintain parts which naturally wear over time.
13.25. Damage to ceramic or glass surfaces unless directly caused by an incident included in the Plan.
13.26. Commercial or business use, including use by charities, not-for-profit organisations, local government or similar bodies, unless we agree in writing beforehand.
13.27. Fraud or attempted fraud or where the condition of a Product is inconsistent with the repair request made.
13.28. Accessories and consumable or user-replaceable items such as external fuses, batteries, light bulbs, filters, removable attachments, cables, plugs, covers and similar items unless expressly included.
13.29. For Products with screens, pixel failure within manufacturer tolerances, screen marks or screen burn.
13.30. For televisions, issues arising from broadcasting changes, software interfaces, satellite/cable systems or access to cables within the fabric of a building.
13.31. AGAs and gas tumble dryers.
13.32. Where a boiler is beyond economical repair, we will not replace it as part of the repair service; any boiler replacement contribution is governed by Schedule B below.
13.33. Anything listed as not included in Schedule A or in the Plan Summary.
14. PAYING YOUR FEES
14.1. You may pay monthly, quarterly or annually where those payment frequencies are offered for your Plan. Your Plan Summary and payment schedule will show the amount, frequency and method of payment.
14.2. If you pay by Direct Debit, we will collect payments in accordance with the payment schedule and any applicable Advance Notice. If a collection is unsuccessful, we may represent the payment or contact you to arrange another payment method.
14.3. Where you pay annually, the annual fee must be paid in accordance with the payment schedule. Where you pay monthly or quarterly, the instalments are a payment method for the annual Plan Period and do not by themselves change the Plan Period or cancellation provisions.
14.4. If a payment becomes overdue and remains unpaid for 14 days after we remind you, we may suspend services until the account is brought up to date. Repair requests arising during suspension may not be considered unless and until payment is received, subject to your statutory rights.
14.5. We may use a third-party collection service to recover amounts properly due to us, subject to applicable law.
15. YOUR RIGHTS TO MAKE CHANGES TO YOUR PLAN
15.1. If you want to change your Plan, please contact us. We will tell you whether the change is possible and explain any resulting price, service or other changes before asking you to confirm.
16. YOUR RIGHT TO END YOUR PLAN
16.1. Your rights when you end the Plan depend on why and when you end it. Nothing in this clause affects your statutory rights.
16.2. If our services are faulty or mis-described, we make a material change you do not accept, we suspend services for a substantial period, or you otherwise have a legal right to end the Plan because of something we have done, you may be entitled to end the Plan and receive the remedies required by law.
16.3. COOLING-OFF PERIOD: For a distance or off-premises service contract, you normally have 14 days from the day after the contract is entered into to cancel. If you expressly ask us to begin providing services during that cancellation period and later cancel, you may have to pay a proportionate amount for services supplied up to cancellation. You will only lose the statutory cancellation right before the 14 days has ended where the service has been fully performed, performance began at your express request and you acknowledged that you would lose the cancellation right once the service was fully performed. These statutory rules do not prevent Homesure from offering more generous cancellation rights.
16.4. After the cooling-off period, you may still end your Plan before the Plan Period ends. Unless your statutory rights require otherwise:
If you have not received repair or replacement services during the current Plan Period, we will refund fees paid in advance for the remaining full months of the Plan Period.
If you have received repair or replacement services, no refund will normally be due and you may be required to pay the cost of services already supplied, capped at the total Plan fee for the current Plan Period less fees already paid.
If you cancel within the first 12 months, an administration charge of up to £25 may apply, as stated in the existing solicitor-drafted terms.
17. HOW TO END YOUR PLAN
17.1. To cancel, contact us on 0800 068 3534 or email customerservice@homesurewarranties.co.uk. You may also write to Homesure Warranties Ltd, Alum House, 5 Alum Chine Road, Westbourne, Bournemouth, Dorset, England, BH4 8DT. If you are using your statutory cancellation right, you may also use the model cancellation form in Schedule C, although use of that form is not compulsory.
17.2. Cancelling a Direct Debit instruction with your bank does not by itself notify us that you want to end the Plan. Please contact us directly so we can process the cancellation correctly and tell you whether any amount remains due or is refundable. Your rights under the Direct Debit Guarantee are unaffected.
18. OUR RIGHT TO END YOUR PLAN
18.1. If you fail to pay fees when due, fail to provide information we reasonably require, or prevent us from providing services, we may end the Plan after taking reasonable steps to resolve the issue. Where the Plan ends, we will account for any fees paid in advance and any amount properly due for services already supplied, subject to applicable law.
18.2. We may also end the Plan by giving you at least 28 days' notice. If we do so for reasons not caused by your breach, we will provide a pro-rata refund of fees paid in advance for the unexpired part of the Plan Period.
18.3. We will confirm in writing when we end or decide not to renew your Plan.
19. OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU
19.1. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of contract or failure to use reasonable care and skill, but we are not responsible for loss or damage that is not foreseeable.
19.2. We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of applicable statutory rights, or defective products where the law does not permit exclusion.
19.3. We will make good damage to your property caused by our negligence while carrying out services, but we are not responsible for pre-existing faults or for reasonable access works or cosmetic making-good where those costs are excluded under the Plan and the law permits that exclusion.
19.4. We supply services for domestic and private use only. We are not liable for business losses such as loss of profit, business interruption or loss of business opportunity.
20. HOW TO COMPLAIN
20.1. If you are unhappy with our service, contact our customer services team on 0800 068 3534 or at customerservice@homesurewarranties.co.uk. You may also write to our registered office. We will investigate the complaint fairly and explain the outcome. Our Complaints Policy on the website gives further information.
21. ALTERNATIVE DISPUTE RESOLUTION
21.1. Alternative dispute resolution (ADR) is a process in which an independent body may help resolve a dispute without court proceedings.
21.2. If an ADR scheme is available and applicable to your complaint, our final response will explain the relevant provider and how to contact it. We do not name a specific ADR provider in these terms unless Homesure has confirmed the current arrangement.
22. CHANGES TO THESE TERMS AND CONDITIONS
22.1. We may modify or replace these terms where reasonably necessary to comply with law, regulation, industry guidance or codes of practice; correct errors or ambiguities; or reflect changes to the services we provide.
22.2. We will give reasonable written notice of a change that materially affects your rights or obligations. Where the law or these terms give you a right to cancel because of a material change, we will explain that right in the notice.
23. HOW WE MAY USE YOUR PERSONAL INFORMATION
23.1. We will use personal information in accordance with our Privacy Policy, available on the Homesure website. The Privacy Policy explains our purposes, lawful bases, recipients, retention approach and your data-protection rights.
24. OTHER IMPORTANT TERMS
24.1. With our permission, you may transfer the Plan to a new owner of an eligible Product by giving us the information we reasonably require.
24.2. We may transfer our rights and obligations under the Plan to another organisation. We will tell you if this happens and will ensure the transfer does not reduce your contractual rights.
24.3. The Plan is between you and us. No other person has a right to enforce its terms except where the law provides otherwise.
24.4. Each paragraph operates separately. If a court or relevant authority finds part of the Plan unlawful, the remaining terms will continue in force.
24.5. Delay in enforcing a term does not waive our right to enforce it later.
24.6. If services are delayed by an event outside our reasonable control, we will contact you and take reasonable steps to minimise the effect. If there is a risk of substantial delay, you may have a right to end the Plan and receive an appropriate refund for services not supplied.
24.7. These terms are governed by English law. If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in the courts of the jurisdiction in which you live.
24.8. Nothing in these terms reduces your statutory rights. Information about consumer rights is available from Citizens Advice and other official consumer-advice services.
